Update on automatic acquisition of British citizenship


In a bizarre policy-like update, the Home Office has amended its guidance on automatic acquisition of British citizenship:

“While the Home Office assesses recently identified legal issues, the policy for acquisition of citizenship by individuals born in the UK between 1 January 1983 and 1 October 2000 inclusive to an EEA national parent has been suspended. However, if someone has already been recognised as a British citizen, for example through the issue of a British citizen passport, we will continue to treat them as such.

This comes after the case of R (on the application of Roehrig) v Secretary of State for the Home Department [2023] EWHC 31 (Admin) was heard by the High Court in January, casting doubts on the British citizenship of children of EU citizens. You can read more about the case here
