Court of Justice confirms British citizens lost their EU citizenship because of Brexit


This isn’t going to come as a surprise to many lawyers. The Court of Justice has concluded that

The loss of the status of citizen of the European Union, and consequently the loss of the rights attached to that status, is an automatic consequence of the sole sovereign decision taken by the United Kingdom to withdraw from the European Union, and not of the withdrawal agreement or the Council’s decision approving that agreement.

This was, I think, an application for permission to appeal against an earlier ruling by the general court, so the earlier ruling stands. So that’s the end of that, then. You can read the full order for yourself at Silver and Others v Council of the European Union C-499/21, C-501/21, C502/21.
